Welcome to Mark Haydon. In these terms, "we", "us" and "our" refer to Mark Haydon, a business registered in India with its place of business at BE-117, Street No. 2, Hari Nagar, New Delhi – 110064.
These Terms of Service govern your use of www.markhaydon.com and your purchase of any products from us. Please read them before ordering. By using this website or placing an order, you agree to be bound by these terms and by our Privacy Policy.
1. Who can use this site
By using this website you confirm that you are at least 18 years old, or that you are using it under the supervision of a parent or guardian. You agree that the information you provide to us — name, address, phone number, email — is accurate and complete, and you'll keep it up to date so we can fulfil your orders and contact you.
If you create an account, you are responsible for keeping your password secure and for activity that happens under your account.
2. Our products
We make every effort to show our products accurately. However, colours and appearance can vary depending on your screen, its settings and the lighting in our photographs. Slight variation between the photograph and the garment you receive is normal and is not a defect.
All garment measurements shown in our size charts are of the garment itself, laid flat, not of your body. We recommend measuring a similar garment you already own and comparing.
We may change or discontinue any product at any time, and we may limit quantities available to any customer, region or order.
3. Orders
When you place an order you are making an offer to buy. Your order is accepted only when we confirm dispatch. We may decline or cancel an order — for example if the item is out of stock, if there was a pricing error, if we cannot deliver to your PIN code, or if we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.
Products bought from us are for personal use, not for commercial resale.
4. Prices and payment
All prices are shown in Indian Rupees and are inclusive of GST. The price shown on the product page is what you pay; we do not add tax at checkout.
Delivery is free on all orders across India. Any applicable charges will be shown clearly before you confirm your order.
We accept UPI, credit and debit cards, net banking, wallets and Cash on Delivery, processed through our payment partner. We do not store your card details.
Prices, discounts and offers can change without notice. The price that applies to your order is the one shown at the time you place it. Where a promotion has its own terms, those terms apply alongside these.
5. Delivery
Delivery timelines are set out in our Shipping Policy. All timelines are estimates. Once we hand a parcel to our courier partner, delivery timing depends on them, and we are not liable for delays caused by couriers, weather, strikes or other events outside our control. We will always help you track and follow up on a delayed parcel.
6. Returns and refunds
Returns, exchanges, cancellations and refunds are governed by our Refund Policy, which forms part of these terms.
7. Intellectual property
The content on this website — text, product photographs, graphics, logos and page design — is owned by or licensed to Mark Haydon and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.
You may use this website for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute or use our content or trade marks commercially without our written permission.
8. Acceptable use
You agree not to use this website:
- For any unlawful purpose, or in breach of any Indian law or regulation
- To infringe our intellectual property rights or those of anyone else
- To harass, abuse or harm any person
- To submit false information or impersonate anyone else
- To upload viruses or malicious code, or to interfere with the operation or security of the site
- To scrape, harvest or extract data from the site by automated means without our permission
We may suspend or terminate your access if you breach these terms.
9. Reviews and content you submit
If you post a review, comment, photograph or other content, you confirm it is your own and does not infringe anyone's rights, and you grant us permission to display and use it in connection with our business, including in marketing. We may remove content that is unlawful, offensive, misleading or otherwise inappropriate. We are not obliged to keep submitted content confidential or to pay for it.
10. Third-party links and services
This site may link to websites operated by others, and uses third-party services for payments, delivery and analytics. We are not responsible for the content, accuracy or practices of third-party sites. Please read their terms and privacy policies before using them.
11. Errors
Occasionally information on this site may contain typographical errors or inaccuracies relating to product descriptions, pricing, offers, delivery charges or availability. We reserve the right to correct any error and to change or cancel an order if the information it was based on was inaccurate — including after you have placed it. If we cancel a paid order for this reason, we will refund you in full.
12. Our liability
We provide this website and our products with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the site or our products. Nothing in these terms limits or excludes any right you have under the Consumer Protection Act, 2019 or any other law that cannot lawfully be excluded.
13. Relationship with Shopify
This store is powered by Shopify, which provides the platform that lets us sell to you. Any purchase you make is made directly with Mark Haydon. Shopify is not responsible for any aspect of the sale between you and us.
14. Privacy
How we collect and use your personal information is set out in our Privacy Policy. We handle personal data in accordance with applicable Indian data protection law, including the Digital Personal Data Protection Act, 2023.
15. Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts at New Delhi.
16. Changes to these terms
We may update these terms from time to time. The current version is always on this page, with the date it was last updated at the top. Continuing to use the site after a change means you accept the updated terms.
17. Grievance and contact
If you have a complaint or a question about these terms, please contact us. We aim to acknowledge every complaint within 48 hours and resolve it within 30 days, in line with the Consumer Protection (E-Commerce) Rules, 2020.
